Man’s ‘murder advice’ to undercover cops tainted conviction in brutal Etobicoke killing, appeal court rules

A Toronto judge failed to follow the law when he allowed the jury at a 2019 trial to hear the accused man’s statements to undercover police officers about how to kill someone, Ontario’s top court said this week, overturning the man’s conviction in the murder and sexual assault of a 34-year-old Etobicoke woman.

In ordering a new trial for Najib Amin for the killing of Sylvia Consuelo in her home in 2016, the Ontario Court of Appeal noted that without the evidence of Amin’s “murder advice,” the Crown’s case is now so weak that its ability to prove whether he’s guilty could be “jeopardized.”
