A Toronto judge has tossed a sexual assault case and castigated police for “terminal failings” when it comes to promptly disclosing video evidence — a recurring problem that has already led to other criminal cases being thrown out.
As he stayed the case of a man accused of sexually assaulting a co-worker at St. Joseph’s Hospital, Ontario Court Justice Michael Waby said he echoed the comments of other judges who have been expressing frustration about the “current state of affairs” regarding delayed video disclosure by the Toronto Police Service.
